3. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our DMCA agent with a written notification containing the following information (as required by 17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material: Identify the material that you claim is infringing and provide enough information for us to locate it (e.g., the URL of the page containing the material).
  3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent containing the following:

  1. Identification of the material: Identify the material that was removed or disabled and the location at which it appeared before it was removed.
  2. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which SignalCast may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.
  4. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action, we may restore the removed content.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, SignalCast has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Fair Use Notice

SignalCast's AI-generated summaries are created for the purpose of commentary, criticism, and educational use. We believe our summaries constitute fair use under 17 U.S.C. § 107 because they are:

  • Transformative: Our AI creates original commentary and analysis, not mere reproduction
  • Non-substitutional: Summaries do not replace the original podcast experience
  • Attributed: We always credit the original podcast and creators
  • Limited: We summarize key points, not reproduce entire episodes

However, we respect copyright holders' rights and will work with content creators to address any concerns.
